In these Terms and Conditions we, our, us, mean Stan Cash Superstore Pty Ltd ABN 26 160 223 914 trading as Billy Guyatts,and “our website” means the URL www.billyguyatts.com.au and you and your means you, the customer. Personal Information has the meaning given to it under the Privacy Act 1988 (Cth)These Terms and Conditions together with your order and the order reference number provided to you constitute the entire agreement (“Agreement”) between us and you for the supply of products. No other Terms and Conditions will apply.
Billy Guyatts is an Australian Website only. We only sell and ship Products within Australia. We will not make deliveries outside of Australia.
It is your responsibility to take precautions to adequately protect yourself from the risk of viruses, malicious software or other issues which may damage your computer. We take no responsibility for any damage arising from the connection to our website or links to any other related websites.
The prices payable for your order are clearly set out in the website. All prices are inclusive of GST. The price of the items does not include the delivery charge. You agree to pay the delivery charges specified at the time you submit your order.
We reserve the right to modify prices published on our website at any time. Prices can change and our latest price is always displayed on our website www.billyguyatts.com.au and not any third-party websites.
Prices for items ordered are fixed on acceptance of your order. Subsequent price changes either up or down will not be applied to accepted orders.
Payment can be made through direct deposit, pay pal, credit card, Humm, Afterpay and Zip. Please note we do not accept international credit cards of any type.
Payment processing services offered via the website are outsourced to third party providers. If we do not receive or are unable to successfully process payment in full for your order for any reason, we will cancel your order.
Where we choose to use third-party services in conjunction with this website, including secure payment options for purchasing goods from the website, you may also be required to create and maintain a separate account that may include Personal Information and financial account details. You must comply with the terms of use and privacy policies of such third-party websites, and should review the relevant third party provider’s target market determination before use. Non-compliance with these third-party websites may limit your ability to order, be provided with goods, rebates or bonus offers in conjunction with your purchase.
If you choose to pay by Visa or MasterCard credit card or debit card, you authorise us to debit the amount that is payable for an accepted order from your nominated card.
You will be required to provide us with the following details on your Visa or MasterCard: card type, name on card, card number, 3-digit card verification value (CVV2) and the card expiry date.
We may not be able to, or may decline to, accept payment from you by your nominated payment method at any time for any reason including without limitation:
(a) Where our fraud detection systems detect possible irregularities;
(b) Because your financial institution or other payment provider has declined payment; or
Because your payment card has expired. Where this is the case, we reserve the right to cancel your order and place your order on hold and request you to provide additional information (for example, proof of identify documents) or arrange payment by another method. Goods you have ordered will not be dispatched to you until your payment for the goods has cleared. If your payment cannot be processed, your order will be rejected and we will notify you by email.
Orders placed on a weekend or a Public Holiday will not begin payment processing until the next business day. Business days are Monday through Friday, excluding Victorian Public Holidays.
Please choose carefully and review all products in your cart when completing the checkout process as your order cannot be cancelled once we have provided you with the order reference number. Except in accordance with our customer satisfaction policy no refunds, credits or replacements are offered if you have changed your mind about the ordered products, make an incorrect choice, or failed to verify and accurately provide information when placing an order.
We will use our best endeavours to supply your order, however we reserve the right to cancel any order without notice for any reason If an order is cancelled in this manner, any payments made will be refunded fully to you.
Billy Guyatts will use its best endeavours to deliver ordered goods to your nominated delivery address within the time frames specified at the time of placing the order. If, for any reason, we are unable to supply a particular item within this timeframe, we will notify you as soon as possible.
If an item ordered is not available, we will provide you with an alternative and if this is not acceptable to you, we will provide you a full refund.
Except as required by law we will not be liable to anyone for any losses suffered or incurred due to any delivery delays or cancellations of orders.
Following the payment for your order, the title for goods passes to you when the goods have been delivered to the nominated address.
If you are under eighteen (18) years of age, you cannot order via our website. Should we suffer any damage or other losses as a result of a transaction entered into by a minor using our website, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who caused any transactions to be entered into via our website to the extent permitted by law.
For all damaged or faulty goods, in the first instance please call the manufacturer or supplier as per the product warranty information. If you have any difficulties with the manufacturer or supplier, please do not hesitate to contact us on 1300 727 967 to resolve your issue.
Please call Customer Service on 1300 727 967 within 24 hours of receipt of damaged goods. Photo proof of the damages will be required. Customer service will assess the damage and if applicable will organise an exchange, refund or credit in accordance with the Australian Consumer Law. Billys will pay the freight cost if the product is being returned by supplying an Australia Post Return Label. If possible goods should be returned complete in their original packaging. You will need to attach the label and take the goods to the Post Office for despatch.
Please allow up to 10 days turnaround for the replacement of damaged goods (longer for WA and remote areas). Replacements cannot be despatched until damaged goods are received. Billys will not be responsible for additional damage during the return process.
Please call Customer Service on 1300 727 967 if your goods are Dead on Arrival (DOA). Billys will pay the cost of return for DOA items. Customer Service will issue an Australia Post Return Label to enable the goods to be returned and exchanged or refunded. If possible goods should be returned complete in their original packaging. You will need to attach the label and take the goods to the Post Office for despatch.

Please note - goods that are deemed not to be DOA will either be returned to you at your cost, or refunded net of the cost of return and a restocking fee. As such, please be careful to fully test the product prior to requesting a return.
All electrical products contained and sold from this website are covered for a limited time by the Manufacturers of the product or Billys’ suppliers. Billys abides by manufacturers warranty terms and conditions, including the right to repair or replace in accordance with the terms of the warranty during the warranty period.
In the event that outside our DOA Policy and the Australian Consumer Law, a product becomes faulty under warranty, it will be the customer's responsibility to return the item to Billys, if the item is more than 30 days from date of delivery.
Please contact Customer Service on 1300 727 967 to arrange a Return Authority number (RA) for the return of your goods. It is recommended (at the customers expense) that returned items are sent registered post to enable the goods to be tracked. Billys will not accept responsibility for returned goods that are damaged or lost in transit. Goods cannot be replaced until the faulty goods are received.

If you change your mind, you have 10 days to get in contact with Customer Service on 1300 727 967. As long as the product is in the same condition as it arrived to you with all packaging and accessories, we will fully reimburse you for the amount you paid for the product less the cost of shipping and a 25% restocking fee of up to 25% (and a minimum of $10). If the product price included free or reduced delivery costs, the reimbursed amount will be reduced by the cost of shipping to your address.
Billy Guyatts may modify the terms and conditions of this Agreement at any time, and such modifications will be effective as soon as they are posted. By continuing to use the website after this Agreement has been modified, you agree to be bound by the modification. A copy of the current Agreement is displayed on the website at all times.
We retain the right at all times to monitor, retain and disclose any information as necessary for us to satisfy our obligations under any applicable laws. In order to purchase goods on our website you must provide us with your personal details and contact information. All Personal Information collected via the website will be managed in accordance with our Privacy Policy. You also consent to receiving direct marketing communications from Stan Cash and BSR unless you opt out.
You acknowledge that all forums, discussion groups and content postings are public and not private communications. Information or postings submitted to the forum or discussion group by users is subject to our review and moderation. We reserve the right to remove without notice or moderate any content in a forum or discussion group or any content posting for any reason.
We reserve the right to terminate, without prior notice, your access to your Billy Guyatts user account.
Nothing in these terms and conditions is intended to limit or exclude any provisions of the Competition and Consumer Act 2010 (Cth) or other similar state or territory laws (Consumer Law). In the event of any inconsistency between these Terms and the Consumer Law, the Consumer Law will prevail. You release and hold harmless Stan Cash and BSR from and against any loss, liability or damage that you or the owner or lessee may suffer. Subject to the Consumer Law, the liability of Stan Cash and BSR is expressly limited to the cost replacement of the product or the reperformance of the applicable service.
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
These Terms and Conditions are governed and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia. The State or Federal Courts located in Victoria will have the exclusive jurisdiction to hear and determine any claims or disputes arising out of or relating to these Terms and Conditions.
A provision of these Terms and Conditions which is unenforceable in a jurisdiction shall be ineffective to the extent of the unenforceability without invalidating the remaining provisions of this Agreement or affecting the validity or enforceability of the provision in another jurisdiction.
